BKK Transport TERMS AND CONDITIONS

  1. This agreement between the CUSTOMER and BKK TRANSPORT & BROKERAGE, Inc. You agree and consent to any and all modified terms and conditions hereunder. This Agreement may not be modified, amended, and/or changed by you in any manner. This agreement between the customer and BKK transport and brokerage allows BKK transport and brokerage Inc. to contract with another licensed and insured Motor Carrier to transport the vehicle/equipment/load described in this shipping order.

  2. The Transportation of your vehicle/heavy equipment/freight is Door to Door. There may be situation when a Carrier will not be able to pick up or deliver your vehicle to your door because of low hanging trees, low hanging wires, narrow streets and residential area restrictions. In this case another location as (grocery store, gas station, etc.) that is closest to pick up or delivery location will be arranged to load or unload the vehicle/equipment/freight.

    Under no circumstances, customer/shipper is allowed to help load or unload vehicle/equipment off the trailer, or climb on the trailer on his own risk and BKK transport brokerage/carrier is not liable for any damages,accedents.

  3. BKK TRANSPORT AND BROKERAGE must provide Customer with an approximate pickup and delivery dates .Carrier/Transportation Company will call customer usually 3 to 12 hours prior to pick up or delivery.However, delays may occur prior to, and/or during transport due to weather, road conditions, mechanical problems, etc. There are NO guarantees pick-up or delivery times and dates. BKK TRANSPORT & BROKERAGE / Carrier shall not be held responsible for loss or damages occasioned by delays of any kind or for any reason, car rental fees or any accommodation fees. BKK TRANSPORT & BROKERAGE / Carrier shall not be held liable for failure of mechanical or operating parts of your vehicle.

  4. BKK TRANSPORT AND BROKERAGE / Carrier jointly and separately are authorized to operate and transport his/her or their motor vehicle between its pick up location and the destination set forth on this shipping order-bill of lading.

  5. Customer must prepare vehicle/equipment for transport. All loose parts, fragile accessories, low hanging spoilers, etc. must be removed or secured. Shipper shall remove all non-permanent outside mounted luggage and other racks prior to shipment. Vehicles must be tendered to carrier in good running condition (unless otherwise noted) with no more than a half tank of fuel (prefer 1/4 tank).Any part of the vehicle that falls off during transport is the Customer’s responsibility including damages caused by said part to any vehicles(s) and/or person involved. BKK Transport & Brokerage/CARRIER will not be responsible for any damages caused by freezing of engine, cooling system, batteries, or due to leaking fluids, etc. BKK TRANSPORT & BROKERAGE/CARRIER will not be responsible for any exhaust system, mufflers, tail pipes, or any mechanical function damage to include engine, transmission, rear end, drivetrains, wiring systems, air bags, clutches, computerized components (anything that is mechanical or electrical). BKK Transport & Brokerage/ Carrier will not be responsible for any convertible tops that are loose, torn, or have visible wear. This includes any canvas or material coverings.

  6. Customer must disarm any alarm system installed in the vehicle or provide proper instructions for this matter. In the event said alarm sounds and there are no keys or instructions to turn it off, carrier may silence alarm by any means.

  7. Luggage and personal property must be kept in the trunk only, with no heavy articles, and not to exceed 100 lbs. Carrier and BKK TRANSPORT & BROKERAGE is not liable for personal items left in vehicle, or for damage caused to vehicle from excessive or improper loading of personal items. No personal property shall be transported in customer’s vehicle(s) that includes but is not limited to Explosives, Guns, Ammunition, Flammable Products, Narcotics, Negotiable and Legal Papers, Alcoholic Beverages, Jewelry, Furs, Money, Live Pets, Live Plants or any Contraband. BKK TRANSPORT & BROKERAGE /Carrier will not be held responsible for delivery of personal property. If Customer decides to put items in the vehicle he does it at his own risk.

  8. International orders, the car must be empty except for factory installed equipment. Indicate serial #, and give car’s approximate value in U.S. dollars. Shipper is responsible for the proper customs paperwork (ask the assigned carrier for help with these documents).

  9. Once a carrier has been assigned to pick up and transport Customer’s vehicle BKK Transport & BROKERAGE notifies the Customer via email or phone (the email address and phone provided in your car shipping order).

  10. If the vehicle is inoperable,overweight or oversize (dual or oversize wheels, extra-large, racks, lifted, limo, etc.), Customer must inquire as to extra charges.Customer is responsible if any charges for forklift service, tow truck service or crane service where is used to load or unload vehicle ,equipment,freight. If BKK TRANSPORT & BROKERAGE is not advised of inoperable, oversized / modified vehicles, or overweight vehicle ,equipment ,freigh, prior to pick-up, all extra charges must be paid in cash, cashier’s check or money order upon delivery to the carrier. Additional type of payment options as credit card or paypal may be available. If vehicle, freight , load, equipment, can not be loaded for any reason (or driver has to wait will extra charge other than deposit for drivers time to be paid ) customers deposit will not be refunded (will be charged as dry run fee). At delivery if freight, load, vehicle, equipment cannot be unloaded for any reason customer is agreed to and will be charged extra fees for drivers waiting time and any other ways to be loaded that need to be unloaded (tow truck, forklift, etc).   11. WE HAVE MONEY BACK GUARANTEE POLICY. If the Customer cancels his order, prior to the assignment of a Carrier, the deposit or full payment will be refunded in full. However, if the Customer decides to cancel his order after a CARRIER has been assigned the deposit or part of full payment (partial amount equal to deposit ) will NOT be refunded. Also If any Permit Fees are been Paid for oversize,overweight will not be refunded.

  12. The Customer agrees that BKK TRANSPORT & BROKERAGE has the right to reject any order for any reason at any time.Deposit or Full payment will be fully refunded and just transaction fees will be deducted.Full Payment for Shipping vehicles to Port will be made before pick up.

  13. At the time of pick up, Customer and Carrier will carefully inspect the vehicle for pre-existing damage (exterior only) by completing a vehicle inspection report. The Carrier and Customer will both acknowledge the condition of the vehicle and Customer will sign and receive a copy of the bill of lading.

  14. At the time of delivery, Customer and Carrier will carefully inspect the vehicle for transportation damages. The Carrier and Customer will both acknowledge the condition of the vehicle and Customer will sign and receive a final copy of the bill of lading.

  15. Damage must be noted in the proper place on the Bill of lading and signed by the Customer, regardless of weather or time of day. Signing the bill of lading and inspection report without notation of any damage verifies that Customer has received vehicle(s) in satisfactory condition, and that BKK Transport & Brokerage / Carrier, and their agents are relieved of any further responsibility. Trucking damage claims are covered by a minimum of 3/4 of million dollars public liability and property damage. All claims must be submitted in writing within 24 hours of delivery. BKK Transport & Brokerage will share the carrier insurance policy upon request. Department of Transportation regulations require that all claims be filed in writing and all tariffs be paid in full before claim can be processed. BKK Transport and Brokerage is not responsible for any damages. Carrier is responsible only. 

  16. Carrier accepts responsibility of vehicle after pre-inspection is done and is signed by the Customer. Carrier responsibility will end when the vehicle is delivered and Customer signs final inspection.

  17. BKK Transport & Brokerage / Carrier will not be responsible for damage caused by acts of God, hail or storm damage, or damage resulting from worn/broken parts of vehicle/item.

  18. The Customer shall, in their absence, designate a person to act as their agent at the point of pick up and/or delivery, if for any reason they are unavailable.

  19. Customer warrants that will pay Deposit or Full payment (As customers option or request) to BKK Transport & BROKERAGE before pick up and will pay the remaining balance to ( if deposit was paid only before pick up ) the Carrier / Driver at Delivery the vehicle as agreed. And will not seek to charge back a credit card stop a check or refuse to pay to offset any dispute for damage claims and/or delays etc. It is the Customer’s responsibility to have any payment due when the Carrier arrives. All payments to Carrier where apply must be paid by Cash, Cashier’s check or Money order. Certified funds must be made payable to the delivering car carrier and not – BKK Transport & Brokerage. Personal checks or credit cards will NOT be accepted for the remaining balance from the Carrier. If customer wish to pay the remaining balance or full payment by credit card or paypal he has to request it at the time of booking his vehicle/equipment shipping. Depending on the Type of Payments all payments has to be completed before pick up, before delivery or on delivery. The Customer agrees that if the payment cannot be made by these methods, the vehicle/item will be stored at the Customer’s expense until Customer pays in full all transport charges. Should the Customer be unable to accept delivery for any reason, the vehicle/item will be placed in storage. Any and all storage and delivery charges will be the responsibility of the Customer.

This Agreement shall be construed in accordance with the laws of the State of Illinois.

The parties agree that any legal action arising out of this agreement shall be filed in a court of competent jurisdiction . The customer hereby submits to the jurisdiction of such courts and waives any and all defenses based on lack of personal jurisdiction

This agreement and any shipment here under is subject to all terms and conditions of the carrier’s tariff and the uniform straight bill of lading, copies of which are available at the office of the carrier.

This supersedes all prior written or oral representation of BKK TRANSPORT & BROKERAGE, INC and constitutes the entire agreement between Customer and BKK TRANSPORT & BROKERAGE, INC and may not be changed except in writing signed by an officer of BKK TRANSPORT & BROKERAGE, INC
